General terms and conditions of online sales

General terms and conditions of online sales

These terms and conditions of sale apply automatically and without restriction to all orders placed via the website. They may be changed without notice. The purchase of entrance tickets by a customer implies a willingness to comply with these terms and conditions of sale without reservation.

These terms and conditions apply to the exclusion of all other terms and conditions of sale, in particular those in respect of physical sales or sales via partners’ sales networks.

1) Price and number of tickets

a) The ticket prices are shown in Swiss francs, inclusive of taxes.
b) The total number of tickets available per transaction may not exceed the number specified by the organiser, which will be indicated for each event as appropriate.
c) All orders, wherever they originate, are payable in Swiss francs.
d) The organiser reserves the right to modify the price list (available to view under the “Practical Information” tab) at any time. However, the tickets will be invoiced on the basis of the prices in force at the moment the order is placed.
e) No refunds will be given for tickets lost or stolen.

2) Payment

a) Tickets bought via the website may only be paid for by credit card or through a Paypal account. If an invoice is required, there will be a charge to cover administration and postage.
b) Electronic payments made via the website are securely encrypted.

3) Personal data

a) On receipt of an order, the company CimArk SA will collect certain items of personal data from the purchaser for the purpose of processing the order. This data will be used to process and monitor the order placed by the purchaser of the ticket, as well as in cases where the event in question is postponed or cancelled. Ticket purchasers give tacit consent to CimArk SA (and The Ark Fundation) to send them by e-mail its newsletters as well as information about any future events organised by the company’s partners. Any ticket purchaser not wishing to receive such information, or deciding to cancel this consent at a later date, should send a simple e-mail to this effect to info@cimark.ch.

4) Ticket delivery

a) Once the transaction has been confirmed, the ticket purchaser will receive an e-mail containing the digital ticket(s), to be printed out by the customer on A4 paper.

5) Checking the tickets

a) The reproduction, duplication or forging of a ticket in any way whatsoever is strictly forbidden. Tickets may not be reproduced and this would not confer any benefits. Only the first person presenting the e-ticket or a reproduction thereof will be admitted to the event. This person will be presumed to be the legitimate ticket holder. Anyone reproducing a ticket or using a copy of a ticket will be liable to prosecution.

6) Cancellation and refunds

a) From the moment of purchase, tickets may not be exchanged, resold or returned, unless an event is cancelled and the organiser has decided to refund the ticket price.
b) Should an event be cancelled, and only in this case, refunds will be paid to ticket purchasers by the organiser.
c) Under no circumstances may a ticket be refunded, even if the purchaser of the ticket was unable to use it.
d) In the case of disputes, the legal venue is Sion.
